In the recent decision of Elders Rural Services Australia Ltd v Registrar of Plant Breeder’s Rights [2012] FCAFC 14, the full Federal Court contemplated the relationship between the current Plant Breeder’s Rights Act 1994 (Cth) (new Act) and the repealed Plant Variety Rights Act 1987 (Cth) (old Act).
