SRO announces discretionary trust payroll tax amnesty until 4 November 2011 *

The State Revenue Office announced in Payroll Tax Bulletin Oct 11 PTX 1/11 an ‘opportunity’ for employers (including employment agencies) to make a voluntarily disclosure of payroll tax liabilities where they have used a discretionary trust to restructure the payment of wages to employees or contractors as trust distributions to beneficiaries.


Changes to land rich duty in Victoria from 1 July 2012 *

Deceased estates & testamentary trusts: sro confirms duty exemption *

Earlier this month, the State Revenue Office (SRO) clarified its position regarding section 42(1)(a) of the Duties Act 2000 (the Act), confirming it will treat a transfer from the executor to the trustee of the testamentary trust as if it were a transfer to a beneficiary, provided the transfer is in conformity with the trusts contained in the will of the deceased, and is not for valuable consideration.
